PERSONAL DATA PROTECTION POLICY
I. CUSTOMER PERSONAL DATA PROTECTION POLICY
By registering to use and using Mytoon’s products and services, establishing agreements, and allowing Mytoon to process the Customer’s personal data, the Customer accepts all the regulations mentioned in this Personal Data Protection Policy. Mytoon will only collect, use, store, and process the Customer’s personal data in accordance with the provisions of (1) Legal documents (including Decree No. 13/2023/ND-CP dated April 17, 2023, on personal data protection and any amendments, supplements, and replacements of this Decree over time); (2) This Personal Data Protection Policy; and (3) Other contracts and agreements between the Customer and Mytoon.
- Personal Data Processed:
When customers register and use the service, Mytoon may collect and process the following types of information:
– For individual customers: Full name; Phone number; Email; Identity card information (ID card/Passport).
– For corporate customers: Company name; Tax code; Business license; Email; Head office address; Transaction address; Full name, phone number, address, and position of the contact person; and other relevant information…
- Use of Personal Information
– We collect and use customers’ personal information for legitimate purposes and in full compliance with the terms outlined in this “Privacy Policy.”
– When necessary, we may use this information to contact customers directly through the following means: sending welcome letters, order confirmations, thank-you notes, and technical and security information. Customers may also receive periodic emails containing updates on new products, services, upcoming events, or recruitment opportunities, provided they have opted in to receive such notifications
- Disclosure of personal information
– Except for cases where personal information is used as stated in this policy, we commit to not disclosing customer’s personal information to external parties.
– In some instances, we may hire an independent entity to conduct market research projects. In such cases, customer information will be provided to this entity for the purpose of conducting the project. This third party will be bound by a confidentiality agreement, under which they are only permitted to use the provided information for the purpose of completing the project.
– We may disclose or provide customers’ personal information in genuinely necessary cases as follows:
a/ When requested by competent state agencies;
b/ In cases where such information is necessary to protect our business’s legitimate rights under the law;
- Confidentiality of personal information
– When customers send their personal information to us, they agree to the terms stated above. We are committed to protecting the security of our customer’s personal information in every way possible.
– However, due to technical limitations, no data transmitted over an internet connection can be 100% secure. Therefore, we cannot make a firm commitment that the information customers provide to us will be kept absolutely secure, and we cannot be held responsible in cases including, but not limited to, unauthorized access to customers’ personal information, such as cases where customers voluntarily share information with others…”
– Therefore, we also recommend that customers keep information related to their access password confidential and not share it with anyone else
– If using a shared computer, customers should log out or close all open website windows.
II. MYTOON’S RIGHTS AND OBLIGATIONS
- Rights:
– Process Customer’s personal data according to the correct purpose, scope, and other contents agreed with the Customer and/or agreed by the Customer;
– This policy may be amended from time to time, and customers will be notified of any such amendments through Mytoon’s communication channels prior to their implementation.
– Have the right to refuse any unlawful requests from customers
– Decide to implement appropriate measures to protect customers’ personal data.
– To the extent permitted by law, if the Customer requests to withdraw consent and/or requests Mytoon to delete or restrict the processing of their personal data, Mytoon reserves the right to limit, suspend, or terminate, in whole or in part, the provision of products and services to the Customer due to the lack of necessary information and data required to provide such products and services. The Customer shall bear full responsibility for any consequences or damages that may arise, and Mytoon shall not be liable for any loss incurred by the Customer in such cases
– Other rights are specified in this Policy and in accordance with the applicable laws.
2. Obligations:
– Comply with the legal regulations in the process of handling customers’ personal data;
– Implement appropriate security measures to prevent unauthorized access, alteration, use, or disclosure of customers’ personal data;
– Adhere to the customer’s lawful requests regarding their personal data;
– Cooperate with the competent governmental authorities and other relevant organizations or individuals to minimize damages upon detection of any unlawful activities related to customers’ personal data;
– Be responsible to customers for damages arising from Mytoon’s failure to comply with legal regulations on data processing or to act in accordance with the scope and objectives agreed upon with customers;
– Other obligations are set forth in this Policy and in accordance with the applicable laws.
III. INFORMATION CONFIDENTIALITY POLICY
Scope of Confidential Information: Confidential information refers to any information, data, or documents under the legal ownership or reasonable control of the parties that are considered confidential and have not been disclosed to the public, disclosed by the Customer or the Customer’s Representative to Mytoon at any time; regardless of whether they are prepared or communicated by any means or contained in any form (including but not limited to written, oral, or electronic data forms). This includes, but is not limited to, the following information:
– Documents and information pertaining to Trade Secrets and Intellectual Property Rights as outlined in Section 1.2 and Section 1.3 of Article 1 below
– Technical information includes, but is not limited to, information regarding products, technical drawings, diagrams, samples, work instructions, performance verification, information related to management processes, contracts, project documents, technical data, technical know-how, ideas, concepts, and initiatives (whether recognized or unrecognized), designs, technical specifications, blueprints, sketches, charts, models, functions, capabilities, and designs (including, but not limited to, computer software or any other information contained in drawings or technical specifications).
– Information regarding the business operations of a party includes, but is not limited to, information about processes, plans, business strategies, marketing, customers, partners, finances, liabilities, human resources, and projects at any stage (whether completed, in preparation, or currently being implemented; including information arising at any stage of the project development cycle), licensing procedures, and establishment processes Mytoon’s Commitment to Information Security:
– Mytoon commits to doing everything necessary and appropriate to protect the Customer’s confidential information and will not disclose or facilitate its disclosure, nor allow any third party to access, read, or process it, except for authorized purposes.(For each contract, Mytoon develops an attached Non-Disclosure Agreement (NDA))
IV. DISPUTE RESOLUTION PROCESS.
This policy is concluded based on the goodwill between Mytoon and the Customer. During the implementation process, if a dispute arises, the parties will proactively resolve it through negotiation in the spirit of mutual benefit. If the dispute cannot be resolved, it will be brought before the People’s Court with jurisdiction to settle it according to the provisions of the law. The losing party will bear related costs during the dispute process.
In addition to the above principles, Mytoon commits to complying with legal regulations on data protection as updated from time to time.
